Travel Website Terms and Conditions

These terms and conditions ('Terms') govern the relationship between you and Travel Website Limited (Travel Agent License Number : 354113) (referred to herein as "Travel Website") in relation to the Services, and the provision of Suppliers Rights. By using the Services you acknowledge that you have read and understood, and agree to be bound by these terms. You must be at least eighteen (18) years old to use the Services. If you do not agree with any part of these Terms and Conditions, you must not use this Site.

Travel Website Limited reserves the right, at its sole discretion, to amend the Terms and Conditions at any time by posting the amended terms on this Site. The amended terms shall be effective from and after the date that they are posted. The Terms and Conditions may not otherwise be amended.

 

1. Travel Products

1.1. Product Terms

1.1.1   In addition to these terms, Travel Providers and hotels may impose (and you must comply with) their own terms and conditions in relation to their Travel Products or Hotel Rights (“Product Terms”) (for example, an airline's terms of carriage). Where applicable, you must accept and agree to those Product Terms to complete your Booking. You should carefully read the Product Terms specific to the applicable Travel Products or Hotel Rights before completing your Booking.

         1.2.  Flights

1.2.1   According to airline policy, flight segment should be used in pre-determined sequence. Otherwise, the air-ticket will become invalid.

1.2.2 In most cases, accumulated Mileage Award Scheme is not applicable to discounted air-ticket /flight+hotel (package). All Mileage Award Scheme redemption must be approved and confirmed by the airline.

1.2.3 According to airline policy, it is the sole responsibility of the customers to pass through the boarding gate on or before the time specified by the airline. The airline will not bear any responsibility nor make concession to accommodate such customers.  Travel Website shall not accept any refund request from those who fail to check-in on schedule. Additional expenses or fares incurred due to your late arrival or premature departure are your sole responsibility.

1.2.4 Most of the check-in counter will open at 2- 3 hours before departure time and present a valid travel document & check in baggage. Most of check-in counter will be closed 40- 60 minutes before the estimated departure time. (For details, please refer to the policy of the related airline.

1.2.5 In order to shorten the waiting time for travelers at the airports, most of airlines are providing online check-in service. Customers may log on to the related airline official websites within 24-48 hours before flight departure. For further information, please visit related airline official website.

1.2.6 Airline regulations disallow female customers, who are 28 weeks’ pregnant or more at the time of departure. If in doubt, please check with the concerned airline and consult your doctor. Infants must be at least 6 weeks old to travel by air and must either sit on an adult's lap or in baby cot. Please contact the airline for details on appropriate seating arrangement. Children aged 2 years or more must require a seat.

1.2.7 For seat assignment request (especially in economy class), Travel Website has no control over the request and cannot make guarantee, even for in-advance request to the airline.

1.2.8 Travel Website will pass special requests from customers, such as meal, wheelchair & baby cot etc., to the airline / hotel for final approval. Such special requests are not guaranteed and form no part of your booking with us.

1.2.9 Travel Website does not accept responsibility for transport delays, changes, delays or cancellations resulting from Acts of God, weather, traffic, airport conditions, strikes or other causes, nor liability for additional expenses or loss of vacation time incurred by customers, resulting therefrom.

1.2.10 Travel Website assumes no responsibility or liability in the event you miss your flight/ferry due to weather or traffic conditions, or late arrival for your connecting flight/ferry, or for any other reason beyond the Company’s control. If you utilize other transportation for connections to and from your   flight, you should allow sufficient time to take into account delays or possible cancellations.  

1.2.11 Flight schedule of group (Block Seats) product is for reference only. The airline reserves the right to change the flight number and time at any time.

1.2.12 Group (Block Seats) air ticket will be sent to customer within 1 working day# prior to departure via email.

1.2.13 GV Promotion Fare for 2 or more adult travelers and the booking must be reserved under the same Airline passenger name record for all travelers, separate bookings are not accepted. All travelers must check-in, travel together for the whole journey. Airlines reserve the right to deny boarding and void the tickets if travelers not meeting the requirements.

1.2.14  Taxes and surcharges are generally included in the price of the ticket, and if there is a difference, a tax must be paid at check-in at the local level. Travel Website will charge a handling fee of HK $ 30 - 70 per ticket.

 

1.3.1 Travel Website acquires rights to access certain hotel rooms (“Hotel Rights”) directly or indirectly from hotels. When you book a hotel room through Travel Website you agree to purchase the applicable Hotel Rights from Travel Website You also agree:

a. to comply with the applicable Product Terms; and

b. that any further charges relating to your Booking (for example, minibar charges, and any transfer costs and meals not included in the Hotel Rights acquired) will be invoiced by, and paid by you to, the applicable hotel.

c. Breakfast is not included unless stated otherwise. Some hotels may include meal such as breakfast, lunch, dinner or tea set, which are not applicable for child or infant.  Some hotels may charge additional government taxes. Hotels reserve the right to charge additional cost for the child in room, according to different rules in different hotels

d. Hotel star rating, quality and hotel website are for reference only. These ratings are not regarded as standard and official local ratings. They can vary among hotels in the same class and / or in different countries. It is the sole responsibility of the customer whether to make the decision to book.

e. The hotel pictures / information on the website, including amenities and facilities are provided by the hotel. This information is for reference only. The Company is not liable and responsible for any discrepancy between the website pictures and actual settings.

f. Based on individual country’s regulations, hotel reservation for customers under the age of 18, who are not travelling with their parents/ adults, is subject to hotel approval.

g. For most of the hotel, will depend to the height and the age of the child, restricted that child who sharing room with parents need an extra bed charges compulsory. If such information is not provided during reservation, customers will bear any extra cost upon check in.

h. Two single beds or one double bed are generally provided in a “Double Room”.

i. The size of a “Small Double Room” (also known as “Semi Double Room”) is smaller than the standard double room. The bed size in “Small Double Room” is also smaller than the average bed size. “Small Double Room” may be allowed to accommodate a maximum of two adults in different sexuality or one adult and one child.

g. Two single beds or one double bed plus an additional bed, which is normally a single bed, rollaway bed or sofa bed are generally provided in a “Triple Room”.

k. Additional hotel benefit is only applicable to a maximum of two registered guests per room and is only valid during their stay.  The benefit is non- transferable and non-refundable.

1.4. Packages

1.4.1 Package (Flight + Hotel) are made available by Travel Website by offering flights and accommodation (as agent for the applicable Services Provider). When you book a Package through the Booking Facility, you agree to purchase that Package from Travel Website. You also agree:

a. to comply with the applicable Product Terms for each of the flight and Hotel Rights; and

b. that any further charges relating to your Booking (for example, minibar charges, and any transfer costs and meals not included in the Package charges) will be invoiced by, and paid by you to, the applicable hotel or Services Provider.

c. Travel Website will not, and is under no obligation to, disclose what savings to you as part of a Package are comprised.

1.4.2 All accompanied customers must travel on the same flight and check-in together in the whole journey, unless otherwise specified. If passenger chooses to forfeit the scheduled flight on his/ her own during the journey, the un-used portion is not refundable and passenger can do so at his/her own risk. The company is clear of any liability.

1.4.3 According to the Travel Industry Council’s instructions, a 0.15% stamp charge on the tour receipt is levied for the Travel Industry Compensation Fund for providing protection to outbound travelers joining package tours against default of travel agents and financial assistance to outbound travelers who died or are injured in accidents while travelling abroad on package tours.  For details, please contact the Travel Industry Compensation Fund Management Board at 3151 7945.

1.4.4 Package prices quoted do not include airport & local transfers, unless otherwise specified.

1.4.5 Child fare is only applicable to children from the age of 2 to 11 at the time of departure and they must stay with two adults. It does not include bed or breakfast.

1.4.6 The prices shown for airfare, hotel accommodation or cruise package products are on per- person basis.  Unless stated otherwise, all rooms are standard rooms.

1.4.7 Price quoted does not include services charge for tour leader, local guides, drivers and non-accompanying staff.  Customers are required to pay the services charge for the localsupported companies.

1.4.8 The departure date and price of each tour group is different from each other.  The content is only applicable for specific group type and departure date. The price quoted in reservation prevails.  And the price is subject to the increase in high season.

 

1.5. Local Tour, Theme Tickets, Local Transport

1.5.1 The date of use, price and fare conditions of each product is different from each other. The content is only applicable for specific product and date of use. The price quoted in reservation prevails and the price is subject to the increase in peak season.

 

1.5.2 If you want to participate in local activities, you need to comply with the guidelines and arrangements by the activities providers. Please consider other factors like your age, physical condition, health status, and prevailing weather conditions and the nature of activities, etc., before making the decision. You participate in local activities at your own risk and you acknowledge and assume the risks inherent therein and shall bear all responsibilities for the consequences resulting therefrom. The Company accepts no responsibility and shall not be liable for any injury, illness, damage, loss, accident, expense, delay or other irregularity resulting from your participation in any activity. If any query, please obtain opinions from medical practitioners or other appropriate professionals.

 

1.5.3 The images and videos are for reference only. No refund or compensation will be provided if customers missed the tour due to personal factors such as late arrival.

 

1.5.4 In case of any termination of product usage by customer's own request, no refund will be provided.

 

1.5.5 No prior notice would be made for any possible changes on pricing and terms.

 

1.5.6 Travel Website reserves the right to change, cancel or rearrange the itinerary and transportation according to the service provider, when the tour being affected by any of the traffic, weather or other unavoidable factors.

 

1.5.7 The itinerary is subject to the final arrangement by local staff.

 

1.5.8 The personal information provided by customer should match that on passenger travel document. A Change fee will be charged for any corrections on per time basis.

 

1.5.9 Customer should print out the confirmation voucher to redeem the local tour product and make sure the accuracy of personal information, the purchased fare type coincided with the requirement of the product, such as age and height limit. In case of failure to provide the voucher or client’s personal data does not match with the voucher, customer may not be permitted to redeem the product and/or need to bear all the extra cost.  Travel Website will not make any refund or compensation.

 

1.5.10  The operation hours of the attraction may change without prior notice. Customer should visit the official website of the attraction before departure.

 

1.5.11  The pick-up time may vary depends on the pick-up location or any other factors. Customers will be informed before departure.

 

1.5.12  The actual pick up time will vary depends on the traffic conditions, weather or other factor.

 

1.5.13  The number of vehicles is subject to peak season, public holiday and other factors. Please make a reservation as soon as possible. The final order result will be sent to your email as soon as possible after confirmation from the provider.

 

1.5.14 Travel Website, as an agent of the service provider, is to provide local tour products and service of its customers (“the Services”). It is expressly declared that Travel Website acts solely in the capacity of an agent for the suppliers of the Services. All tickets issued for the Services are subject to the terms and conditions under which the Services are offered or provided (details of which have been provided to all customers). The customers shall be deemed to have consented to such terms and conditions, upon acceptance of the tickets. Travel Website shall not be or become liable or responsible, in whole or in part, directly or indirectly, for any injury, illness, damage, loss, accident, expense, delay or other claim which may result from the supplying of the Services, whether caused by a defect of any vehicle, breakdown of equipment, strikes, theft, the negligence or default of any supplier of services or their agents, or otherwise, nor shall it be liable for any cancellation of or charges in itineraries or schedules or additional expense or loss of vacation time incurred by customers, resulting therefrom. Travel Website shall make every effort to deal with any delay situation. However, Travel Website shall not be responsible for any cost arises from such circumstances.

 

1.6. Car hire

1.6.1 Travel Providers make cars available to hire through the Website. Where you hire a car:

a. you enter into a contract to hire that car directly with the Travel Provider;

b. you must comply with any Product Terms and requirements of that Travel Provider (including procuring the appropriate insurance) and the driving laws of the country in which you have hired the car; and

c. Travel Website has no responsibility for and excludes all liability in relation to that car hire

1.6.2 The car rental booking price is guaranteed in the local currency of the car rental location and has been converted to Hong Kong dollars (where applicable) at the current rate of exchange. The price in Hong Kong dollars may vary as a result of currency exchange fluctuations and as such can only be used as a guide.

1.6.3 Your credit card details will be supplied to the car rental company to secure your booking and you will be required at car pick-up location to provide your credit card.

1.7.  Insurance

1.7.1 Third-party insurers makes travel insurance (“Insurance”) available to purchase through the Website. Before you purchase Insurance you must read and consider the product disclosure statement and the terms and conditions thereof before making any decision to proceed.

a. If you purchase Insurance:

b. you enter into a contract in respect of that Insurance directly with the third-party insurer;

c. Travel Website does not act as an insurer or provide that Insurance to you; and

d. Travel Website has no responsibility for and excludes all liability in relation to that Insurance, including in relation to any claims made by you under it.

2. Travel requirements

2.1 Passports

2.1.1 All departing passengers require a valid passport for international travel. This means the passport must be valid for a set minimum period beyond your travel dates (the required minimum period depends on the country you visit).

2.1.2 Please ensure you have a valid Passport well in advance of travel as either the airline staff or immigration authorities will not allow you to pass through customs and board your flight without this documentation.

2.2 Visas

        2.2.1 A visa provides you with the authority as a non-citizen to travel to another country. Some countries will not allow you to enter without a visa, or in some cases, without proof of a return or onward electronic or paper ticket.

2.1.2 Please ensure you have a valid Visa (as applicable) for all the countries you are travelling to which require a visa well in advance of travel as either the airline staff or immigration authorities will not allow you to pass through customs and board your flight without this documentation.

2.1.3 Visas are obtained from the issuing authority in Hong Kong, usually an embassy. Visa requirements vary by country you are travelling to, including countries that you are transiting and the current citizenship you hold so please ensure that you check well in advance of your travel dates to allow sufficient processing time as required by the embassy. If you have booked a one-way ticket please ensure you have checked with the Consulate of the country you are travelling to in order to ensure that you comply with their laws and regulations

2.3 Restrictions & Regulations

2.3.1 Travel Website recommends before travelling you check the HKSAR Government Security Bureau website relating to the countries you are travelling to for any applicable travel advisories relevant to those countries.

3. Payments and refunds

3.1 Payment

3.1.1 Bookings must be paid in full at the time of booking charged to your chosen credit card

3.1.2 By clicking "Pay", you accept:

a. Each Travel Provider's offer to sell the Travel Products; and/or

b. Travel Website's offer to sell the Flights, Hotel Rights, Packages Local Tours, Theme Tickets, Local Transfer, All Local Arrangements, Car Hire and  Insurance, to you for the price set out in your shopping cart, and subject to these terms and any applicable Product Terms.

3.1.3 Your Booking is not binding on you, the applicable Travel Provider or Travel Website, until you click "Pay" and your acceptance is received by Travel Website

3.1.4 Your Booking is not confirmed and Travel Documentation will not be issued until authorisation has been obtained from the relevant card company. Any confirmed Booking is subject to your credit card approval for the transaction.

3.2 Credit check

3.2.1 You:

a. authorise Travel Website's agents to:

(i) charge all fees incurred to the credit card designated by you;

(ii) disclose your credit card details to, and obtain information from, any financial institution or credit card issuer to verify the credit card and identification details that you provide;

(iii) take steps to confirm that there is sufficient credit on your credit card account to meet likely charges;

b. authorise your credit card issuer or financial institution to verify that the credit card and identification details you have provided to Travel Website are accurate; and

c. consent to Travel Website supplying your billing, payment and identification information (including personal information) to those Travel Providers and/or hotels who will supply the Travel Products and/or Hotel Rights in your Booking to you.

3.2.2 Before Travel Website proceeds to process any travel booking on your behalf or issues your Documentation, various checks are taking place to validate the integrity of credit card information and in certain circumstances the credit card holder will be required to submit verification documentation to substantiate identity. This process is intended to reduce the potential risk for fraud and disruption to passengers upon check in.

3.2.3 If your credit card is not approved Travel Website will attempt to contact you. Where Travel Website cannot contact you and the ticket issuance period lapses (thereby making the Booking invalid), Travel Website will have no choice but to cancel the booked arrangements. Under these circumstances Travel Website accepts no responsibility for any re-booking costs.

3.2.4 Travel Website reserves the right at its or their absolute discretion (as applicable) to decline or accept bookings made from outside Hong Kong. Any automatic booking acknowledgement for such bookings are conditional contingent on Travel Website 's view of any financial risks, potential ticket despatch delays, or other international regulations that may apply.

3.2.5 If payment is not received from your card issuer or its agents for any reason, you agree to pay Travel Website all amounts due on demand.

4. Changes and cancellations

4.1 General

4.1.1 Because Travel Website is reliant on the availability of Travel Products from Travel Providers, Travel Website reserves the right to amend your Booking at any time in consultation with you if:

a. an error is made by the Travel Provider or hotel in relation to a Travel Product or Hotel Right; or

b. in circumstances beyond Travel Website 's reasonable control, the Travel Provider or hotel advises that it is unable to provide the Travel Product or Hotel Right at the price advertised on the Website.

In such circumstances additional charges may have to be paid by you for the Travel Products or Hotel Rights and/or your itinerary may need to be changed.

4.1.2 Information about how to change or cancel your Booking is available, please call our Customer Service Hotline at (852) 5802-2300.

4.1.3 There will be a charge a handling fee by Travel Website. The amount should be informed by our staff.

4.1.4 If you cancel any Travel Product (including any element of a Package) you may incur cancellation charges from the Travel Providers supplying the cancelled Travel Product and you agree to indemnify Travel Website (and any related parties) for any fees or charges incurred by them in relation to your cancellation.

4.1.5 Fare and availability of Travel Products and Hotel Rights are not guaranteed until air ticket(s) and / or voucher(s) are issued.

4.2 Air Tickets

4.2.1 Your right to a refund of an airfare booked on the Website is governed by the terms and conditions of the airfare you purchased and is determined by the applicable airlines. Many fares are non-refundable. Airline charges or cancellation fees may apply to your particular airfare.

4.2.2 Travel Website shall only be liable to provide a refund to you to the extent that it actually receives a refund from the relevant Travel Provider. Where refunds are due to you from a Travel Provider, Travel Website will provide reasonable assistance to you in claiming such funds from that Travel Provider. In that situation, Travel Website is authorised (but not obliged) to seek such refunds from the Travel Provider directly and on its own behalf.

4.2.3 Where a refund is applicable, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 3-12months. This is beyond the control of Travel Website.

4.3 Hotels

4.3.1 In the event that you need to cancel your Booking, you must advise Travel Website as early as possible before your check-in date.  Please check the hotel's cancellation policy on your confirmation voucher as there may be penalties. 

4.4 Packages

4.4.1 If you wish to cancel or vary any element of a Package, Travel Website will permit this where it is reasonably able to do so. However your Booking will no longer constitute a Package and you may lose the benefit of the Package, including any savings made from purchasing those elements together as a Package.

 

Where a third party cancels an element of a Package, Travel Website may elect to either cancel that Package in whole, or substitute a substantially similar element for the cancelled element. Travel Website is not liable for the cancellation of an element by a third party, or the consequences of that cancellation (including the consequences of Travel Website’s election to cancel a Package in whole). 

 

5. Pricing

5.1 Pricing

5.1.1 All pricing is reflected in Hong Kong Dollars (HKD) unless otherwise specifically denoted on the screen.

5.1.2 Travel Website makes no representation that its price sales are identical to prices on individual official website of airline, hotels and local entertainments may exist from time to time.

5.1.3 Travel Website reserves the right for marketing and commercial reasons to modify prices.

5.1.4 All handling fees and Insurance (if selected) are non-refundable.

5.2 Currency variations

5.2.1 For some international mix-and-match flights Travel Website's flights results page indicates that some return flight pricing has been converted to HKD at the exchange rate on the day of Booking. Variations to your final price may occur due to currency fluctuations. Please note, where any pricing has been converted from a foreign currency to HKD your credit card company may charge a conversion fee.

5.3 Coupon codes

5.3.1 Coupon codes may be made available from time to time to offer additional savings on a Travel Product. Coupon codes may apply to selected Travel Products or Hotel Rights only and may be subject to a minimum spend requirement. All coupon code Bookings are subject to availability.

5.3.2 Coupon codes are valid for the duration of the respective promotion only and only one coupon code per Booking may be used. If multiple coupon codes are available at the same time, they are not cumulative and it is at the discretion of the customer to select the coupon code they wish to apply

5.3.3 Coupon codes have no cash or refund value and cannot be returned for cash or its equivalent. Coupon codes cannot be applied to the cost of existing Bookings and cannot be used for amendments to existing Bookings, irrespective of whether a coupon code was used for the original Booking.

5.3.4 Travel Website reserves the right to alter or withdraw coupon code promotions at any time.

6. Your obligations

6.1 Your account

6.1.1 To use the Booking Facility you will be required to create an online account (Account) and/or provide:

a. personal information, including in some cases passport details;

b. billing information;

c. any other information reasonably required by Travel Website to complete your Booking; and

d. an Account password.

6.1.2 You are responsible for all use of the Services, and all transactions entered into by means of the Services, under your Account. Travel Website takes no responsibility for any transactions which may occur as a result of a disclosure by you of your password to third parties, or through any unauthorised access to your personal information

6.1.3 You shall indemnify Travel Website from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to use of the Services by you or any other person using your membership identification, Account or password.

6.2 Your obligations

6.2.1 You must

a. only access and use the Services:

(i) to make enquiries about and Bookings for Travel Products, Hotel Rights and Packages on the Website (Permitted Purpose);

(ii) in accordance with these terms;

b. have sufficient credit on your credit card account to meet all charges for Travel Products, Hotel Rights and/or Packages you book through the Booking Facility;

c. keep secure any means of identification that Travel Website provides to you in order to access the Booking Facility;

d. comply with all requirements for the Travel Product you have booked, including any Product Terms (where applicable); and

e. ensure that you have the necessary and valid documentation to travel.

 

6.2.2 You must not:

a. access or use the Services:

b. for the purpose of "carrying on a business as a travel agent" within the meaning of Hong Kong legislation regulating travel agents, unless you are a licensed travel agent under that legislation;

c. for any activities which breach any laws, infringe any third party's rights, or breach any standards, content requirements or codes promulgated by any relevant authority;

d. in any way which interferes with other users or defames, harasses or menaces anyone;

e. for any purpose (commercial or otherwise) other than the Permitted Purpose without the express written permission of Travel Website, including any reproduction, data mining, automated querying or similar data extraction processing;

f. reverse or cancel a payment without Travel Website 's prior written consent;

g. resell the Services, Travel Products, Hotel Rights or Packages or any other products and services accessed by means of the Services; or

h. permit any other person to use your user identification to access the Services, or grant a third party the right to access and use the Services.

6.2.3 You are solely responsible for

a. assessing the suitability of any Travel Products, Hotel Rights and Packages for your needs; and

b. all matters relating to complying with the laws and regulations of all immigration authorities of the countries you travel to and from.

6.3 Intellectual property

6.3.1 All the intellectual property rights in the Website and the Booking Facility are owned by Travel Website and/or its related bodies corporate or licensors (as applicable). The only rights you have to this intellectual property are the limited rights to use and access the Website and the Booking Facility for the Permitted Purpose.

6.3.2 You must not:

a. disassemble, decompile, reverse engineer the whole or any part of the software accessed by means of the Services; or

b. modify, copy, transmit, display, perform, publish, license or create derivative works from any information or software accessed by means of the Services.

6.4 Your information

6.4.1 Travel Website may use and disclose any personal information collected by Travel Website about you in accordance with Travel Website's privacy policy, available at https://www.travelwebsite.com/Link/Link/Private . Travel Website may also provide such personal information to Travel Providers as is required to complete your Booking. You accept that the recipients of this disclosure may not have in place privacy policies equivalent to Travel Website's.

6.4.2 Travel Website may use information about you for internal planning or product development purposes in order to improve the quality of Travel Website's services, and may disclose some of your information at an aggregate level for marketing purposes provided that you cannot be personally identified from this aggregated data.

 

7. Liability

7.1 Non-excludable Obligations

7.1.1 Certain laws imply terms (Non-excludable Obligations) into contracts for the supply of goods or services that cannot be excluded.

a. Except in relation to Non-Excludable Obligations:

(i) Travel Website makes no representations, warranties or guarantees in relation to the Travel Products, Hotel Rights, Packages or the availability, continuity, reliability, accuracy, currency or security of the Services; and

(ii)    all warranties and other terms which are not expressly included in these terms and conditions are excluded to the maximum extent permitted by law.

7.2 Exclusions

7.2.1 To the maximum extent permitted by law, Travel Website excludes all liability (including for negligence) for direct, indirect, consequential or incidental damages, lost profits or savings or damages for disappointment.

7.2.2 To the maximum extent permitted by law, Travel Website is not responsible or liable (including for negligence) to you for:

a. any technical errors, corruption of data, unauthorized access to your personal data, inaccuracies in information supplied by third parties, or failure by Travel Website to complete Bookings (including if the Services are not available for any reason) where that failure is due to circumstances beyond its control;

b. the quality of the Travel Products or Hotel Rights, or any inconvenience caused or expense incurred to you or any third party as a result of any unsuitability of Travel Products or Hotel Rights for your needs, including for use in association with other travel services;

c. any failure or delay on the part of any Travel Provider or hotels in providing Travel Products or Hotel Rights to you where your Booking has been properly processed;

d. In the course of delivery of any Travel Products or Hotel Rights, except to the extent that responsibility for those matters may be imposed on Travel Website by legislation that cannot be excluded.

7.3 Limitation

7.3.1 Where Travel Website is liable to you under these terms and conditions (including for negligence) in relation to a Non-excludable Obligation, to the maximum extent permitted by law Travel Website’s liability will be limited, at its option, to:

a. resupply of the Services; or

b. payment of the cost of resupplying the Services.

7.3.2 Where Travel Website is liable to you under these terms and conditions (including for negligence) in relation to a Non-excludable Obligation relating to any Hotel Rights (either alone or as part of a Package), to the maximum extent permitted by law Travel Website's liability will be limited, at its option, to:

a. he resupply of reasonably similar Hotel Rights; or

b. payment of the cost of resupplying the Hotel Rights.

c. It is expressly declared that all the airlines concerned, their servants, agents and affiliates are not liable, in contract, tort or otherwise, for any loss, damage or injury howsoever caused to the customers during the time in transit. The ticket in use by such airlines, when issued, shall constitute the sole contract between the airlines and the purchaser of these tickets, who shall be deemed to have full notice of the terms and conditions of such contractors.

 

7.4 Service

7.4.1 Travel Website, as an agent of a service provider, is to arrange and organize hotels, air or other transportation, sightseeing and excursions for the journey of its customers (“the Services”). It is expressly declared that Travel Website acts solely in the capacity of an agent for the suppliers of the Services. All tickets issued for the Services are subject to the terms and conditions under which the Services are offered or provided (details of which have been provided to all customers). The customers shall be deemed to have consented to such terms and conditions, upon acceptance of the tickets. Travel Website shall not be or become liable or responsible, in whole or in part, directly or indirectly, for any injury, illness, damage, loss, accident, expense, delay or other claim which may result from the supplying of the Services, whether caused by a defect of any vehicle, breakdown of equipment, strikes, theft, the negligence or default of any supplier of services or their agents, or otherwise, nor shall it be liable for any cancellation of or charges in itineraries or schedules or additional expense or loss of vacation time incurred by customers, resulting therefrom. Travel Website shall make every effort to deal with any delay situation. However, the company shall not be responsible for any cost arises from such circumstances.

 

 

7.5 Information on the Website

7.5.1 Some of the material accessible through the Website is provided by Services Providers. This material does not form part of the Services, and Travel Website is not responsible for this material. Travel Website does not warrant, and disclaims any liability for the accuracy or completeness of the information provided by Travel Providers in relation to their Travel Products.

 

7.5.2 Information provided through the Website is provided in good faith, and is subject to amendment at any time without notice.

7.5.3 You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the Website.

7.5.4 The Website does not include all the Travel Products available in the market.

 

7.6 General

7.6.1 In case of unexpected incidents such as typhoons, rainstorms, natural disasters, political unrest or epidemic, customers should pay attention to news broadcasts or contact airlines to confirm whether there is any change or cancellation of flight.  As flight operating normally, please follow normal check-in procedure.  The Company shall not be responsible for any additional costs such as hotel accommodation, transportation fees, long distance telephone charges, as a result from the incidents mentioned above. The Company shall be relieved of all liabilities and obligations resulting from the force majeure events mentioned above, which are not exhaustive and shall not be obliged to refund any amount paid to the hotel or any unused portions of the hotel accommodation in such circumstances.

 

7.6.2 The English version of Terms and Conditions shall prevail in the event that there is any discrepancy among versions in other languages

Travel Website Terms and Conditions

These terms and conditions ('Terms') govern the relationship between you and Travel Website Limited (Travel Agent License Number : 354113) (referred to herein as "Travel Website") in relation to the Services, and the provision of Suppliers Rights. By using the Services you acknowledge that you have read and understood, and agree to be bound by these terms. You must be at least eighteen (18) years old to use the Services. If you do not agree with any part of these Terms and Conditions, you must not use this Site.

Travel Website Limited reserves the right, at its sole discretion, to amend the Terms and Conditions at any time by posting the amended terms on this Site. The amended terms shall be effective from and after the date that they are posted. The Terms and Conditions may not otherwise be amended.

 

1. Travel Products

1.1. Product Terms

1.1.1   In addition to these terms, Travel Providers and hotels may impose (and you must comply with) their own terms and conditions in relation to their Travel Products or Hotel Rights (“Product Terms”) (for example, an airline's terms of carriage). Where applicable, you must accept and agree to those Product Terms to complete your Booking. You should carefully read the Product Terms specific to the applicable Travel Products or Hotel Rights before completing your Booking.

         1.2.  Flights

1.2.1   According to airline policy, flight segment should be used in pre-determined sequence. Otherwise, the air-ticket will become invalid.

1.2.2 In most cases, accumulated Mileage Award Scheme is not applicable to discounted air-ticket /flight+hotel (package). All Mileage Award Scheme redemption must be approved and confirmed by the airline.

1.2.3 According to airline policy, it is the sole responsibility of the customers to pass through the boarding gate on or before the time specified by the airline. The airline will not bear any responsibility nor make concession to accommodate such customers.  Travel Website shall not accept any refund request from those who fail to check-in on schedule. Additional expenses or fares incurred due to your late arrival or premature departure are your sole responsibility.

1.2.4 Most of the check-in counter will open at 2- 3 hours before departure time and present a valid travel document & check in baggage. Most of check-in counter will be closed 40- 60 minutes before the estimated departure time. (For details, please refer to the policy of the related airline.

1.2.5 In order to shorten the waiting time for travelers at the airports, most of airlines are providing online check-in service. Customers may log on to the related airline official websites within 24-48 hours before flight departure. For further information, please visit related airline official website.

1.2.6 Airline regulations disallow female customers, who are 28 weeks’ pregnant or more at the time of departure. If in doubt, please check with the concerned airline and consult your doctor. Infants must be at least 6 weeks old to travel by air and must either sit on an adult's lap or in baby cot. Please contact the airline for details on appropriate seating arrangement. Children aged 2 years or more must require a seat.

1.2.7 For seat assignment request (especially in economy class), Travel Website has no control over the request and cannot make guarantee, even for in-advance request to the airline.

1.2.8 Travel Website will pass special requests from customers, such as meal, wheelchair & baby cot etc., to the airline / hotel for final approval. Such special requests are not guaranteed and form no part of your booking with us.

1.2.9 Travel Website does not accept responsibility for transport delays, changes, delays or cancellations resulting from Acts of God, weather, traffic, airport conditions, strikes or other causes, nor liability for additional expenses or loss of vacation time incurred by customers, resulting therefrom.

1.2.10 Travel Website assumes no responsibility or liability in the event you miss your flight/ferry due to weather or traffic conditions, or late arrival for your connecting flight/ferry, or for any other reason beyond the Company’s control. If you utilize other transportation for connections to and from your flight, you should allow sufficient time to take into account delays or possible cancellations.  

1.2.11 Flight schedule of group (Block Seats) product is for reference only. The airline reserves the right to change the flight number and time at any time.

1.2.12 Group (Block Seats) air ticket will be sent to customer within 1 working day# prior to departure via email.

1.2.13 GV Promotion Fare for 2 or more adult travelers and the booking must be reserved under the same Airline passenger name record for all travelers, separate bookings are not accepted. All travelers must check-in, travel together for the whole journey. Airlines reserve the right to deny boarding and void the tickets if travelers not meeting the requirements.

1.2.14  Taxes and surcharges are generally included in the price of the ticket, and if there is a difference, a tax must be paid at check-in at the local level. Travel Website will charge a handling fee of HK $ 30 per ticket.

1.3. Hotel Rights

1.3.1 Travel Website acquires rights to access certain hotel rooms (“Hotel Rights”) directly or indirectly from hotels. When you book a hotel room through Travel Website you agree to purchase the applicable Hotel Rights from Travel Website You also agree:

a. to comply with the applicable Product Terms; and

b. that any further charges relating to your Booking (for example, minibar charges, and any transfer costs and meals not included in the Hotel Rights acquired) will be invoiced by, and paid by you to, the applicable hotel.

c. Breakfast is not included unless stated otherwise. Some hotels may include meal such as breakfast, lunch, dinner or tea set, which are not applicable for child or infant.  Some hotels may charge additional government taxes. Hotels reserve the right to charge additional cost for the child in room, according to different rules in different hotels

d. Hotel star rating, quality and hotel website are for reference only. These ratings are not regarded as standard and official local ratings. They can vary among hotels in the same class and / or in different countries. It is the sole responsibility of the customer whether to make the decision to book.

e. The hotel pictures / information on the website, including amenities and facilities are provided by the hotel. This information is for reference only. The Company is not liable and responsible for any discrepancy between the website pictures and actual settings.

f. Based on individual country’s regulations, hotel reservation for customers under the age of 18, who are not travelling with their parents/ adults, is subject to hotel approval.

g. For most of the hotel, will depend to the height and the age of the child, restricted that child who sharing room with parents need an extra bed charges compulsory. If such information is not provided during reservation, customers will bear any extra cost upon check in.

h. Two single beds or one double bed are generally provided in a “Double Room”.

i. The size of a “Small Double Room” (also known as “Semi Double Room”) is smaller than the standard double room. The bed size in “Small Double Room” is also smaller than the average bed size. “Small Double Room” may be allowed to accommodate a maximum of two adults in different sexuality or one adult and one child.

g. Two single beds or one double bed plus an additional bed, which is normally a single bed, rollaway bed or sofa bed are generally provided in a “Triple Room”.

k. Additional hotel benefit is only applicable to a maximum of two registered guests per room and is only valid during their stay.  The benefit is non- transferable and non-refundable.

1.4. Packages

1.4.1 Package (Flight + Hotel) are made available by Travel Website by offering flights and accommodation (as agent for the applicable Services Provider). When you book a Package through the Booking Facility, you agree to purchase that Package from Travel Website. You also agree:

a. to comply with the applicable Product Terms for each of the flight and Hotel Rights; and

b. that any further charges relating to your Booking (for example, minibar charges, and any transfer costs and meals not included in the Package charges) will be invoiced by, and paid by you to, the applicable hotel or Services Provider.

c. Travel Website will not, and is under no obligation to, disclose what savings to you as part of a Package are comprised.

1.4.2 All accompanied customers must travel on the same flight and check-in together in the whole journey, unless otherwise specified. If passenger chooses to forfeit the scheduled flight on his/ her own during the journey, the un-used portion is not refundable and passenger can do so at his/her own risk. The company is clear of any liability.

1.4.3 According to the Travel Industry Council’s instructions, a 0.15% stamp charge on the tour receipt is levied for the Travel Industry Compensation Fund for providing protection to outbound travelers joining package tours against default of travel agents and financial assistance to outbound travelers who died or are injured in accidents while travelling abroad on package tours.  For details, please contact the Travel Industry Compensation Fund Management Board at 3151 7945.

1.4.4 Package prices quoted do not include airport & local transfers, unless otherwise specified.

1.4.5 Child fare is only applicable to children from the age of 2 to 11 at the time of departure and they must stay with two adults. It does not include bed or breakfast.

1.4.6 The prices shown for airfare, hotel accommodation or cruise package products are on per- person basis.  Unless stated otherwise, all rooms are standard rooms.

1.4.7 Price quoted does not include services charge for tour leader, local guides, drivers and non-accompanying staff.  Customers are required to pay the services charge for the localsupported companies.

1.4.8 The departure date and price of each tour group is different from each other.  The content is only applicable for specific group type and departure date. The price quoted in reservation prevails.  And the price is subject to the increase in high season.

 

1.5. Local Tour, Theme Tickets, Local Transport

1.5.1 The date of use, price and fare conditions of each product is different from each other. The content is only applicable for specific product and date of use. The price quoted in reservation prevails and the price is subject to the increase in peak season.

 

1.5.2 If you want to participate in local activities, you need to comply with the guidelines and arrangements by the activities providers. Please consider other factors like your age, physical condition, health status, and prevailing weather conditions and the nature of activities, etc., before making the decision. You participate in local activities at your own risk and you acknowledge and assume the risks inherent therein and shall bear all responsibilities for the consequences resulting therefrom. The Company accepts no responsibility and shall not be liable for any injury, illness, damage, loss, accident, expense, delay or other irregularity resulting from your participation in any activity. If any query, please obtain opinions from medical practitioners or other appropriate professionals.

 

1.5.3 The images and videos are for reference only. No refund or compensation will be provided if customers missed the tour due to personal factors such as late arrival.

 

1.5.4 In case of any termination of product usage by customer's own request, no refund will be provided.

 

1.5.5 No prior notice would be made for any possible changes on pricing and terms.

 

1.5.6 Travel Website reserves the right to change, cancel or rearrange the itinerary and transportation according to the service provider, when the tour being affected by any of the traffic, weather or other unavoidable factors.

 

1.5.7 The itinerary is subject to the final arrangement by local staff.

 

1.5.8 The personal information provided by customer should match that on passenger travel document. A Change fee will be charged for any corrections on per time basis.

 

1.5.9 Customer should print out the confirmation voucher to redeem the local tour product and make sure the accuracy of personal information, the purchased fare type coincided with the requirement of the product, such as age and height limit. In case of failure to provide the voucher or client’s personal data does not match with the voucher, customer may not be permitted to redeem the product and/or need to bear all the extra cost.  Travel Website will not make any refund or compensation.

 

1.5.10  The operation hours of the attraction may change without prior notice. Customer should visit the official website of the attraction before departure.

 

1.5.11  The pick-up time may vary depends on the pick-up location or any other factors. Customers will be informed before departure.

 

1.5.12  The actual pick up time will vary depends on the traffic conditions, weather or other factor.

 

1.5.13  The number of vehicles is subject to peak season, public holiday and other factors. Please make a reservation as soon as possible. The final order result will be sent to your email as soon as possible after confirmation from the provider.

 

1.5.14 Travel Website, as an agent of the service provider, is to provide local tour products and service of its customers (“the Services”). It is expressly declared that Travel Website acts solely in the capacity of an agent for the suppliers of the Services. All tickets issued for the Services are subject to the terms and conditions under which the Services are offered or provided (details of which have been provided to all customers). The customers shall be deemed to have consented to such terms and conditions, upon acceptance of the tickets. 1.6. Car hire

1.6.1 Travel Providers make cars available to hire through the Website. Where you hire a car:

a. you enter into a contract to hire that car directly with the Travel Provider;

b. you must comply with any Product Terms and requirements of that Travel Provider (including procuring the appropriate insurance) and the driving laws of the country in which you have hired the car; and

c. Travel Website has no responsibility for and excludes all liability in relation to that car hire

1.6.2 The car rental booking price is guaranteed in the local currency of the car rental location and has been converted to Hong Kong dollars (where applicable) at the current rate of exchange. The price in Hong Kong dollars may vary as a result of currency exchange fluctuations and as such can only be used as a guide.

1.6.3 Your credit card details will be supplied to the car rental company to secure your booking and you will be required at car pick-up location to provide your credit card.

1.7.  Insurance

1.7.1 Third-party insurers makes travel insurance (“Insurance”) available to purchase through the Website. Before you purchase Insurance you must read and consider the product disclosure statement and the terms and conditions thereof before making any decision to proceed.

a. If you purchase Insurance:

b. you enter into a contract in respect of that Insurance directly with the third-party insurer;

c. Travel Website does not act as an insurer or provide that Insurance to you; and

d. Travel Website has no responsibility for and excludes all liability in relation to that Insurance, including in relation to any claims made by you under it.

2. Travel requirements

2.1 Passports

2.1.1 All departing passengers require a valid passport for international travel. This means the passport must be valid for a set minimum period beyond your travel dates (the required minimum period depends on the country you visit).

2.1.2 Please ensure you have a valid Passport well in advance of travel as either the airline staff or immigration authorities will not allow you to pass through customs and board your flight without this documentation.

2.2 Visas

        2.2.1 A visa provides you with the authority as a non-citizen to travel to another country. Some countries will not allow you to enter without a visa, or in some cases, without proof of a return or onward electronic or paper ticket.

2.1.2 Please ensure you have a valid Visa (as applicable) for all the countries you are travelling to which require a visa well in advance of travel as either the airline staff or immigration authorities will not allow you to pass through customs and board your flight without this documentation.

2.1.3 Visas are obtained from the issuing authority in Hong Kong, usually an embassy. Visa requirements vary by country you are travelling to, including countries that you are transiting and the current citizenship you hold so please ensure that you check well in advance of your travel dates to allow sufficient processing time as required by the embassy. If you have booked a one-way ticket please ensure you have checked with the Consulate of the country you are travelling to in order to ensure that you comply with their laws and regulations

2.3 Restrictions & Regulations

2.3.1 Travel Website recommends before travelling you check the HKSAR Government Security Bureau website relating to the countries you are travelling to for any applicable travel advisories relevant to those countries.

3. Payments and refunds

3.1 Payment

3.1.1 Bookings must be paid in full at the time of booking charged to your chosen credit card

3.1.2 By clicking "Pay", you accept:

a. Each Travel Provider's offer to sell the Travel Products; and/or

b. Travel Website's offer to sell the Flights, Hotel Rights, Packages Local Tours, Theme Tickets, Local Transfer, All Local Arrangements, Car Hire and  Insurance, to you for the price set out in your shopping cart, and subject to these terms and any applicable Product Terms.

3.1.3 Your Booking is not binding on you, the applicable Travel Provider or Travel Website, until you click "Pay" and your acceptance is received by Travel Website

3.1.4 Your Booking is not confirmed and Travel Documentation will not be issued until authorisation has been obtained from the relevant card company. Any confirmed Booking is subject to your credit card approval for the transaction.

3.2 Credit check

3.2.1 You:

a. authorise Travel Website's agents to:

(i) charge all fees incurred to the credit card designated by you;

(ii) disclose your credit card details to, and obtain information from, any financial institution or credit card issuer to verify the credit card and identification details that you provide;

(iii) take steps to confirm that there is sufficient credit on your credit card account to meet likely charges;

b. authorise your credit card issuer or financial institution to verify that the credit card and identification details you have provided to Travel Website are accurate; and

c. consent to Travel Website supplying your billing, payment and identification information (including personal information) to those Travel Providers and/or hotels who will supply the Travel Products and/or Hotel Rights in your Booking to you.

3.2.2 Before Travel Website proceeds to process any travel booking on your behalf or issues your Documentation, various checks are taking place to validate the integrity of credit card information and in certain circumstances the credit card holder will be required to submit verification documentation to substantiate identity. This process is intended to reduce the potential risk for fraud and disruption to passengers upon check in.

3.2.3 If your credit card is not approved Travel Website will attempt to contact you. Where Travel Website cannot contact you and the ticket issuance period lapses (thereby making the Booking invalid), Travel Website will have no choice but to cancel the booked arrangements. Under these circumstances Travel Website accepts no responsibility for any re-booking costs.

3.2.4 Travel Website reserves the right at its or their absolute discretion (as applicable) to decline or accept bookings made from outside Hong Kong. Any automatic booking acknowledgement for such bookings are conditional contingent on Travel Website 's view of any financial risks, potential ticket despatch delays, or other international regulations that may apply.

3.2.5 If payment is not received from your card issuer or its agents for any reason, you agree to pay Travel Website all amounts due on demand.

4. Changes and cancellations

4.1 General

4.1.1 Because Travel Website is reliant on the availability of Travel Products from Travel Providers, Travel Website reserves the right to amend your Booking at any time in consultation with you if:

a. an error is made by the Travel Provider or hotel in relation to a Travel Product or Hotel Right; or

b. in circumstances beyond Travel Website 's reasonable control, the Travel Provider or hotel advises that it is unable to provide the Travel Product or Hotel Right at the price advertised on the Website.

In such circumstances additional charges may have to be paid by you for the Travel Products or Hotel Rights and/or your itinerary may need to be changed.

4.1.2 Information about how to change or cancel your Booking is available, please call our Customer Service Hotline at (852) 5802-2300.

4.1.3 There will be a charge a handling fee by Travel Website. The amount should be informed by our staff.

4.1.4 If you cancel any Travel Product (including any element of a Package) you may incur cancellation charges from the Travel Providers supplying the cancelled Travel Product and you agree to indemnify Travel Website (and any related parties) for any fees or charges incurred by them in relation to your cancellation.

4.1.5 Fare and availability of Travel Products and Hotel Rights are not guaranteed until air ticket(s) and / or voucher(s) are issued.

4.2 Air Tickets

4.2.1 Your right to a refund of an airfare booked on the Website is governed by the terms and conditions of the airfare you purchased and is determined by the applicable airlines. Many fares are non-refundable. Airline charges or cancellation fees may apply to your particular airfare.

4.2.2 Travel Website shall only be liable to provide a refund to you to the extent that it actually receives a refund from the relevant Travel Provider. Where refunds are due to you from a Travel Provider, Travel Website will provide reasonable assistance to you in claiming such funds from that Travel Provider. In that situation, Travel Website is authorised (but not obliged) to seek such refunds from the Travel Provider directly and on its own behalf.

4.2.3 Where a refund is applicable, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 3-12months. This is beyond the control of Travel Website.

4.3 Hotels

4.3.1 In the event that you need to cancel your Booking, you must advise Travel Website as early as possible before your check-in date.  Please check the hotel's cancellation policy on your confirmation voucher as there may be penalties. 

4.4 Packages

4.4.1 If you wish to cancel or vary any element of a Package, Travel Website will permit this where it is reasonably able to do so. However your Booking will no longer constitute a Package and you may lose the benefit of the Package, including any savings made from purchasing those elements together as a Package.

 

Where a third party cancels an element of a Package, Travel Website may elect to either cancel that Package in whole, or substitute a substantially similar element for the cancelled element. Travel Website is not liable for the cancellation of an element by a third party, or the consequences of that cancellation (including the consequences of Travel Website’s election to cancel a Package in whole). 

 

5. Pricing

5.1 Pricing

5.1.1 All pricing is reflected in Hong Kong Dollars (HKD) unless otherwise specifically denoted on the screen.

5.1.2 Travel Website makes no representation that its price sales are identical to prices on individual official website of airline, hotels and local entertainments may exist from time to time.

5.1.3 Travel Website reserves the right for marketing and commercial reasons to modify prices.

5.1.4 All handling fees and Insurance (if selected) are non-refundable.

5.2 Currency variations

5.2.1 For some international mix-and-match flights Travel Website's flights results page indicates that some return flight pricing has been converted to HKD at the exchange rate on the day of Booking. Variations to your final price may occur due to currency fluctuations. 5.3 Coupon codes

5.3.1 Coupon codes may be made available from time to time to offer additional savings on a Travel Product. Coupon codes may apply to selected Travel Products or Hotel Rights only and may be subject to a minimum spend requirement. All coupon code Bookings are subject to availability.

5.3.2 Coupon codes are valid for the duration of the respective promotion only and only one coupon code per Booking may be used. If multiple coupon codes are available at the same time, they are not cumulative and it is at the discretion of the customer to select the coupon code they wish to apply

5.3.3 Coupon codes have no cash or refund value and cannot be returned for cash or its equivalent. Coupon codes cannot be applied to the cost of existing Bookings and cannot be used for amendments to existing Bookings, irrespective of whether a coupon code was used for the original Booking.

5.3.4 Travel Website reserves the right to alter or withdraw coupon code promotions at any time.

6. Your obligations

6.1 Your account

6.1.1 To use the Booking Facility you will be required to create an online account (Account) and/or provide:

a. personal information, including in some cases passport details;

b. billing information;

c. any other information reasonably required by Travel Website to complete your Booking; and

d. an Account password.

6.1.2 You are responsible for all use of the Services, and all transactions entered into by means of the Services, under your Account. Travel Website takes no responsibility for any transactions which may occur as a result of a disclosure by you of your password to third parties, or through any unauthorised access to your personal information

6.1.3 You shall indemnify Travel Website from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to use of the Services by you or any other person using your membership identification, Account or password.

6.2 Your obligations

6.2.1 You must

a. only access and use the Services:

(i) to make enquiries about and Bookings for Travel Products, Hotel Rights and Packages on the Website (Permitted Purpose);

(ii) in accordance with these terms;

b. have sufficient credit on your credit card account to meet all charges for Travel Products, Hotel Rights and/or Packages you book through the Booking Facility;

c. keep secure any means of identification that Travel Website provides to you in order to access the Booking Facility;

d. comply with all requirements for the Travel Product you have booked, including any Product Terms (where applicable); and

e. ensure that you have the necessary and valid documentation to travel.

 

6.2.2 You must not:

a. access or use the Services:

b. for the purpose of "carrying on a business as a travel agent" within the meaning of Hong Kong legislation regulating travel agents, unless you are a licensed travel agent under that legislation;

c. for any activities which breach any laws, infringe any third party's rights, or breach any standards, content requirements or codes promulgated by any relevant authority;

d. in any way which interferes with other users or defames, harasses or menaces anyone;

e. for any purpose (commercial or otherwise) other than the Permitted Purpose without the express written permission of Travel Website, including any reproduction, data mining, automated querying or similar data extraction processing;

f. reverse or cancel a payment without Travel Website 's prior written consent;

g. resell the Services, Travel Products, Hotel Rights or Packages or any other products and services accessed by means of the Services; or

h. permit any other person to use your user identification to access the Services, or grant a third party the right to access and use the Services.

6.2.3 You are solely responsible for

a. assessing the suitability of any Travel Products, Hotel Rights and Packages for your needs; and

b. all matters relating to complying with the laws and regulations of all immigration authorities of the countries you travel to and from.

6.3 Intellectual property

6.3.1 All the intellectual property rights in the Website and the Booking Facility are owned by Travel Website and/or its related bodies corporate or licensors (as applicable). The only rights you have to this intellectual property are the limited rights to use and access the Website and the Booking Facility for the Permitted Purpose.

6.3.2 You must not:

a. disassemble, decompile, reverse engineer the whole or any part of the software accessed by means of the Services; or

b. modify, copy, transmit, display, perform, publish, license or create derivative works from any information or software accessed by means of the Services.

6.4 Your information

6.4.1 Travel Website may use and disclose any personal information collected by Travel Website about you in accordance with Travel Website's privacy policy, available at https://www.travelwebsite.com/Link/Link/Private . Travel Website may also provide such personal information to Travel Providers as is required to complete your Booking. You accept that the recipients of this disclosure may not have in place privacy policies equivalent to Travel Website's.

6.4.2 Travel Website may use information about you for internal planning or product development purposes in order to improve the quality of Travel Website's services, and may disclose some of your information at an aggregate level for marketing purposes provided that you cannot be personally identified from this aggregated data.

 

7. Liability

7.1 Non-excludable Obligations

7.1.1 Certain laws imply terms (Non-excludable Obligations) into contracts for the supply of goods or services that cannot be excluded.

a. Except in relation to Non-Excludable Obligations:

(i) Travel Website makes no representations, warranties or guarantees in relation to the Travel Products, Hotel Rights, Packages or the availability, continuity, reliability, accuracy, currency or security of the Services; and

(ii)    all warranties and other terms which are not expressly included in these terms and conditions are excluded to the maximum extent permitted by law.

7.2 Exclusions

7.2.1 To the maximum extent permitted by law, Travel Website excludes all liability (including for negligence) for direct, indirect, consequential or incidental damages, lost profits or savings or damages for disappointment.

7.2.2 To the maximum extent permitted by law, Travel Website is not responsible or liable (including for negligence) to you for:

a. any technical errors, corruption of data, unauthorized access to your personal data, inaccuracies in information supplied by third parties, or failure by Travel Website to complete Bookings (including if the Services are not available for any reason) where that failure is due to circumstances beyond its control;

b. the quality of the Travel Products or Hotel Rights, or any inconvenience caused or expense incurred to you or any third party as a result of any unsuitability of Travel Products or Hotel Rights for your needs, including for use in association with other travel services;

c. any failure or delay on the part of any Travel Provider or hotels in providing Travel Products or Hotel Rights to you where your Booking has been properly processed;

d. In the course of delivery of any Travel Products or Hotel Rights, except to the extent that responsibility for those matters may be imposed on Travel Website by legislation that cannot be excluded.

7.3 Limitation

7.3.1 Where Travel Website is liable to you under these terms and conditions (including for negligence) in relation to a Non-excludable Obligation, to the maximum extent permitted by law Travel Website’s liability will be limited, at its option, to:

a. resupply of the Services; or

b. payment of the cost of resupplying the Services.

7.3.2 Where Travel Website is liable to you under these terms and conditions (including for negligence) in relation to a Non-excludable Obligation relating to any Hotel Rights (either alone or as part of a Package), to the maximum extent permitted by law Travel Website's liability will be limited, at its option, to:

a. he resupply of reasonably similar Hotel Rights; or

b. payment of the cost of resupplying the Hotel Rights.

c. It is expressly declared that all the airlines concerned, their servants, agents and affiliates are not liable, in contract, tort or otherwise, for any loss, damage or injury howsoever caused to the customers during the time in transit. The ticket in use by such airlines, when issued, shall constitute the sole contract between the airlines and the purchaser of these tickets, who shall be deemed to have full notice of the terms and conditions of such contractors.

 

7.4 Service

7.4.1 Travel Website, as an agent of a service provider, is to arrange and organize hotels, air or other transportation, sightseeing and excursions for the journey of its customers (“the Services”). It is expressly declared that Travel Website acts solely in the capacity of an agent for the suppliers of the Services. All tickets issued for the Services are subject to the terms and conditions under which the Services are offered or provided (details of which have been provided to all customers). The customers shall be deemed to have consented to such terms and conditions, upon acceptance of the tickets. Travel Website shall not be or become liable or responsible, in whole or in part, directly or indirectly, for any injury, illness, damage, loss, accident, expense, delay or other claim which may result from the supplying of the Services, whether caused by a defect of any vehicle, breakdown of equipment, strikes, theft, the negligence or default of any supplier of services or their agents, or otherwise, nor shall it be liable for any cancellation of or charges in itineraries or schedules or additional expense or loss of vacation time incurred by customers, resulting therefrom. Travel Website shall make every effort to deal with any delay situation. However, the company shall not be responsible for any cost arises from such circumstances.

 

 

7.5 Information on the Website

7.5.3 You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the Website.

7.5.4 The Website does not include all the Travel Products available in the market.

 

7.6 General

7.6.1 In case of unexpected incidents such as typhoons, rainstorms, natural disasters, political unrest or epidemic, customers should pay attention to news broadcasts or contact airlines to confirm whether there is any change or cancellation of flight.  As flight operating normally, please follow normal check-in procedure.  The Company shall not be responsible for any additional costs such as hotel accommodation, transportation fees, long distance telephone charges, as a result from the incidents mentioned above. The Company shall be relieved of all liabilities and obligations resulting from the force majeure events mentioned above, which are not exhaustive and shall not be obliged to refund any amount paid to the hotel or any unused portions of the hotel accommodation in such circumstances.

 

7.6.2 The English version of Terms and Conditions shall prevail in the event that there is any discrepancy among versions in other languages

Ticket Policy

Terms and Conditions for flight:

1. Please be noticed that title (gender) is shown after your full name.(MS/MR for age 12 or above, MISS/MSTR for 11 or below).
2. If the air ticket term and condition allows/airline accept change (flight change/time change/date change, reissue electronic ticket or amendment on passenger name and gender.), upon airline and airline agency (Third party) charges, we will also charge an administrative fee HKD350 for each ticket.
3. If the air ticket term and condition allows refund, upon airline and airline agency (Third party) charges, we will also charge an administrative fee HKD350 for each ticket.
4. Other services (E.g. pre-pay extra luggage fee/online check-in/upgrade booking class {E.g. Economy to Business}/mailing official receipt & electronic ticket/Refund the extra amount), we will charge an administrative fee HKD400 for each ticket.
5.If this flight ticket is a pair, group, or bundle promotion ticket, all passengers listed on the itinerary must travel together for all sectors shown. In case of amendment or refund, all tickets in the itinerary has to be refunded or amended together. *For English full names, the sequence of surname, middle name, last name, and other names must align with how it is shown on your travel document.
6. Traveller names must match with Government-issued photo ID/document(s) exactly. No amendments on Title(s) or Passenger name(s) are allowed once the transaction is completed successfully.
7. Airlines will apply extra charges on excess baggage or optional service according to your itinerary and their standards.
8.The price above does not include any extra charges imposed by Airlines or local government.
9. Please make sure you bring along all required travel documents to verify your identity. (i.e. passport, Mainland Travel Permit for Hong Kong and Macau Residents, visas and cross border cards).
10. It is a general requirement that a remaining of at least 6 months validity for passenger's travel document is needed. (counts on the day leaving that country) Passenger's travel document must fulfill all requirements of destination country.
11.In case of stopover airside transit, passenger can not land the transitting country. Otherwise, passenger has to bear all consequences on possible extra charges or denied boarding imposed by airlines or local government.
12.Passenger should follow airlines' instruction regarding check-in procedures at airport. Failure to follow may result in unable to check-in. You are advised to enquire with airlines or airports for most updated flight information.
13.Where the guest book air tickets through travelwebsite.com, our company will charge a ticket service fee of HK$30 - HK $ 70 per ticket.
